I think it is art - but that doesn't mean it's not vandalism. After all, anything can be a form of art. I could go out in the middle of the road and just sit there until I get hit by a car, and I could call it a form of performance art.

This isn't an either-or situation. Yes, some graffiti is incredibly intricate and detailed, and a lot of work goes into it... but it's still defacing public or private property, which means it's technically vandalism.
